In this case, she mentioned that the Tribunal's determination has not been formally notified to the INE.
Ravel highlighted the lack of regulation in the law regarding the declarative actions of the Tribunal and the need to discuss the scope and effects of these decisions. She also explained that this figure aims to clarify doubts about the challenges to the judicial reform and protect the rights of affected citizens, not to define the powers of authorities as happened in this case.
The councilor expressed her interest in convening a meeting of the General Council of the INE to review the declarative action issued by the TEPJF. She emphasized the importance of making collegiate and plural decisions and expressed her disagreement with the INE's statement that endorses the continuation of the judicial election process following the Tribunal's resolution.
In the TEPJF resolution of October 23, it was decided that the electoral process for judges should continue, but it was clarified that this did not imply taking a position on the amparo suspensions related to the issue, as it was not the Tribunal's competence. This situation has generated a conflict between a court order that prevents the process from continuing and the Tribunal's opinion that electoral processes cannot be suspended.
Finally, Dania Ravel distanced herself from an INE statement that confirms the continuity of the judicial election. She stated that this statement does not reflect the position of the entire institution, as she was not consulted on it, and that a thorough analysis is necessary before reaching definitive conclusions on this issue.
