Discussion on Constitutional Supremacy in Mexico

Next Sunday, October 27, the Chamber of Deputies will discuss and vote on the so-called constitutional supremacy, which involves amending Articles 105 and 107 of the Constitution to prevent challenges to constitutional reforms. The proposal was announced by the Morena deputy Ricardo Monreal.

The coordinator of the Morena bench in San Lázaro informed that the draft is already on the Board of Directors, ready to be sent to the Constitutional Points Commission, chaired by deputy Leonel Godoy, which has begun work with the participation of 27 of its 50 members. This commission will be responsible for drafting the opinion to amend the aforementioned articles.

"It will be sent to the deputies today and a meeting of the Commission will be called; it could be Saturday, Sunday, Monday, or any day they determine. Upon meeting on Sunday, the opinion must be made public," explained Monreal.

Deputy Monreal mentioned that all legal procedures will be followed to ensure a broad and clear discussion in the reporting committees and in the Plenary of the Chamber of Deputies, referring to the importance of a qualified majority in parliamentary decisions.

On the other hand, the Senate approved the draft reform of Articles 105 and 107 of the Constitution with 85 votes in favor and 41 against. This reform aims to establish the inadmissibility of amparos and controversies against reforms to the Constitution, with the goal of reinforcing the sovereignty of the legislative power over the judicial.

The measure seeks to protect recently approved reforms, such as the election of judges, which has faced judicial suspensions, and others in progress, such as the elimination of autonomous bodies, amid criticisms of the Judiciary for lack of impartiality and corruption.
