New Suspension of Judicial Reform in Mexico

The parliamentary group of National Action in the Senate has achieved a new suspension of the reform to the Judiciary, this time granted by a court in Yucatán through an amparo filed by Senator Mayuli Latifa Martínez Simón, representative of Quintana Roo.

In an official statement, they emphasized that this is the second time that an amparo resource presented by the PAN bench has been accepted, promoted not only by Martínez Simón but also by Susana Zatarain and Gustavo Sánchez. The suspension issued on Friday, October 25, establishes that the authorities cannot apply the decree that reforms various provisions of the Federal Constitution, published in the Official Journal of the Federation on September 15, 2024.

The measure implies that authorities are prohibited from carrying out any actions to implement the reformed provisions, as well as the Senate must suspend the electoral process and avoid proceeding with the call to integrate lists and take protest from the eventual winners of the election. It is also mentioned that the State Legislatures, the Congress of Mexico City, the INE, and the Judiciary Council must refrain from executing the decree.

Senator Martínez Simón filed the amparo on October 14, and it was admitted last Thursday. It is noted that a court in Baja California also determined the suspension of the reform, following an amparo filed by Senator Susana Zatarain and Senator Gustavo Sánchez. In their statement, the PAN parliamentary group calls for the resolutions to be respected in accordance with the current legal framework.
