Resignation of Minister Gutiérrez from the Supreme Court

Minister Alfredo Gutiérrez Ortiz Mena submitted his resignation to the Supreme Court of Justice of the Nation (SCJN) in response to the deadlines established in the judicial reform. His resignation does not affect his eligibility to be elected by popular vote next year, as the validity and application of the judicial reform are still considered provisional.

The minister emphasized that he continues to comply with existing regulations and that his resignation is part of the process related to the review of the judicial reform. This resignation is the first of a block of 8 ministers who voted in favor of examining the reform. More resignations are expected throughout the day, including from the president of the Supreme Court and other ministers.

It is important to note that Alfredo Gutiérrez Ortiz Mena's resignation will be effective as of August 31, 2025. Additionally, he emphasized that his decision does not imply an implicit endorsement of the constitutionality of the judicial reform, which will be debated and voted on by the Full SCJN starting next week.

In this context, it is reiterated that the analysis of the constitutionality of the judicial reform by the SCJN is still pending, and a definitive judgment on this matter is anticipated. The resignation of Gutiérrez Ortiz Mena is yet another indication of how the Mexican judicial landscape is being affected and is evolving in light of proposed changes.
