Resignations of Judges Ahead of 2025 Elections

The Senate of the Republic has received a total of 580 resignations from judges and magistrates who have declined to participate in the popular election for judicial positions scheduled for June 1, 2025. Gerardo Fernández Noroña, president of the Senate's Board of Directors, reported this fact, detailing that of these resignations, 380 correspond to magistrates and 200 to judges, including eight ministers of the Supreme Court of Justice of the Nation (SCJN).

Among those who decided to resign are prominent figures such as Minister Norma Piña Hernández and Margarita Ríos Farjat, who specified in her resignation letter that she is doing so after reportedly already receiving retirement benefits. The resignation letters from the SCJN ministers were submitted to the Senate at 11:05 a.m. on Wednesday, October 30.

Highlighting the importance of the process, the president of the Senate's Board of Directors mentioned that the deadline to submit resignations is October 30, emphasizing that three SCJN ministers: Lenia Batres Guadarrama, Yasmín Esquivel Mossa, and Loretta Ortiz Ahlf have chosen to participate in the election.

Adán Augusto López Hernández, coordinator of the Morena senators, anticipated that a debate would be opened regarding these resignations and the election of judges and magistrates. For its part, the Supreme Court of Justice of the Nation confirmed that eight ministers have complied with the seventh transitory provision of the judicial reform and have submitted their resignations to the Senate, effective for seven of them starting August 31, 2025, as determined in the Judicial Reform published in September.

It is specified that Minister Luis María Aguilar, despite submitting his resignation according to the provisions established in the judicial reform, will conclude his position in the SCJN on November 30, 2024. According to the seventh transitory provision of the judicial reform, ministers resigning no later than this date, with effects as of August 31, 2025, will be entitled to their retirement benefits, namely a lifetime pension.
