
The president of the Chamber of Deputies, Sergio Gutiérrez Luna, recently presented a constitutional initiative aimed at guaranteeing the new powers granted to the president of the National Electoral Institute (INE), Guadalupe Taddei. This would allow Taddei to appoint heads of executive bodies without the obligation of prior consultation with the INE Council.
The initiative has caused controversy, as it is argued that it would give the 4T the ability to make decisions without the possibility of legal challenge. Legislators from Morena defend that the "popular mandate" grants them the authority to reform the judiciary and establish restrictions so that citizens cannot oppose governmental decisions.
Although the election of judges and ministers was an important topic in the electoral campaign, the proposed constitutional reform could give excessive power to the Executive over the Legislative and Judicial branches, thereby breaking the established balance of powers.
An example of these actions was provided by Deputy Sergio Gutiérrez, who pointed out that the reform being pursued would allow the president of the INE to appoint officials of her trust without consulting the Council. This situation has generated discontent in various sectors, including INE councilors, who announced that they would file a constitutional controversy against these new powers of Taddei.
The rapid approval of the so-called "constitutional supremacy" by the Morena majority in the Chamber of Deputies has raised doubts about to what extent they will use their legislative power to reform the Constitution and prevent possible revocation of the superpowers granted to the president of the INE.
For her part, President Claudia Sheinbaum has assured that governors from parties allied with the 4T will have secured positions in her cabinet once their terms end. Additionally, she has emphasized that the Court must interpret and not legislate, arguing that the ministers should not rewrite the Constitution. This has generated debates about the scope of functions and the separation of powers in the current political system.
