Approval of Constitutional Supremacy Reform

The modernization of constitutional supremacy has been approved in over 16 Mexican states. The reform aims to prevent judicial reversals of congressional decisions, ensuring popular will. The legislation is expected to be published soon by the President.

The reform of constitutional supremacy has been approved in several Mexican states, including Zacatecas, Tabasco, Mexico City, Quintana Roo, Sonora, Tamaulipas, Campeche, Hidalgo, Nayarit, Oaxaca, Baja California, Chiapas, Guerrero, San Luis Potosí, Puebla, Morelos, Veracruz, State of Mexico, and Durango. After being approved by more than 16 states, it is expected that the Presidency of the Republic will publish it this weekend or, at the latest, on Monday morning.

Minister Juan Luis González Alcántara Carrancá presented a project that will be analyzed by the Supreme Court of Justice, reflecting on the importance of maintaining the Judicial Power in the country. He anticipates that if a potential resolution against the judicial reform proposed by Andrés Manuel López Obrador is not complied with, the people will know that the Court's decisions must be respected.

The reform implies that district judges and circuit magistrates will not be popularly elected in 2025 and 2027, but only the Court ministers, members of the Electoral Tribunal of the Judiciary, and the newly created Judicial Discipline Tribunal. This initiative, presented by the leader of Morena, Luisa María Alcalde, seeks to preserve the will of the majority and avoid the possibility of Congress decisions being judicially reversed.

The reform of constitutional supremacy amends Articles 105 and 107 of the Constitution and aims to protect reforms within it, establishing the inadmissibility of actions for unconstitutionality, constitutional controversies, and amparo trials, among other changes and additions.
