The legal advisor of the Presidency, Ernestina Godoy, criticized the ruling of Judge Nancy Juárez Salas, stating that by ordering the elimination of the Judicial Reform from the Official Journal of the Federation (DOF) she may have committed a crime. Godoy mentioned that the Amparo Law is clear in its inadmissibility in cases of constitutional reform and that the judge's ruling was considered "aberrant, illegal, and inadmissible." Additionally, she pointed out that this could lead to Juárez Salas being subjected to liability.
Godoy emphasized that the ruling of Judge Juárez Salas was issued "against the President of Mexico," Claudia Sheinbaum, and that she acted as if she had supreme power over any other body in Mexico. She argued that the lack of ethics on the part of the judge in this decision creates legal conflicts and directly affects the institutions of the country.
According to Godoy, the constitutional reform impacting the election of judges, magistrates, and ministers has caused a conflict of interest within the Judicial Power. This situation has led to a lack of impartiality on the part of the officials involved, affecting their ability to decide objectively on matters related to the reform.
The legal advisor also mentioned that judges have taken actions that reflect their lack of neutrality, such as stopping work in protest against the reform and suspensions that, according to Godoy, benefit them indirectly. This type of action, she stated, allows them to guarantee their permanence in their positions by halting the entry into force of certain decrees.
Godoy warned that the judge's ruling may have committed the crime of "collusion of public servants" by obstructing the execution of a law. In an article published in a newspaper, she criticizes the illegal actions of the judges to the detriment of citizens, calling for an immediate cessation of their actions. Furthermore, she highlighted that Judge Juárez Salas clearly usurped powers that belong to other authorities by ordering the elimination of the constitutional reform from the DOF.
