
The Nineteenth District Judge in Veracruz, Nancy Juárez, issued an ultimatum to President Claudia Sheinbaum to withdraw the publication of the judicial reform from the Official Federal Gazette (DOF). Juárez stated that if this requirement is not met, the law obliges her to inform the Federal Public Ministry.
"Article 107 of the Constitution is very clear on this matter, as well as Article 252 of the Amparo Law. A crime of contempt of a judicial resolution would be committed by the authority, and in that sense, she would have to inform the (federal) Public Ministry," she pointed out in Aristegui En Vivo.
Juárez specified that, so far, she has been unable to confirm whether the relevant authorities were notified of the resolution demanding the elimination of the reform from the DOF. Once compliance is verified, the competent parties will have 48 hours to comply with the suspension.
The judge clarified that she does not interfere in the decisions of the Public Ministry regarding whether the crime of contempt is updated or if the Attorney General's Office will request an arrest warrant against the president or other non-compliant authorities.
In the case of contempt, the Amparo Law establishes penalties of imprisonment, fines, and disqualification for holding public office. The president has immunity, so a procedure trial will be necessary to remove it.
On October 16, the 19th District Court in Veracruz ordered Claudia Sheinbaum and the head of the DOF to report and prove within 24 hours that the reform publication had been removed from the official gazette.
The legal advisor to the Presidency, Ernestina Godoy, indicated that the judge may have committed the crime of "collusion of public servants." Sheinbaum criticized the judge's decision and announced that the legal advisory would issue a notification for it to be reviewed as a suspension.
On October 21, Nancy Juárez indicated that non-compliance with the order represents a breach of the rule of law. She emphasized that as a judge, her actions are aligned with the legal and constitutional framework, highlighting her experience, academic preparation, and judicial independence in her resolutions.
Juárez explained that citizens requested an amparo trial arguing procedural flaws in the legislative process of the judicial reform. This led to the suspension of the publication in the DOF, which was made effective after its publication. She noted that it is unusual for the authorities to attempt not to comply with this suspension, as they have always complied with these resolutions in the past.
