Mexican Court Orders President to Address Judicial Reform

On October 16, the 19th District Court based in Coatzacoalcos, Veracruz, issued a definitive suspension ordering the President of the Republic, Claudia Sheinbaum, and the director of the Federal Official Gazette, Alejandro López González, to inform and prove the elimination of the publication of the decree validating the judicial reform in the Official Gazette within 24 hours of being notified.

If this request is not complied with, the 19th District Judge in Veracruz, Nancy Juárez, would be obligated to inform the Public Prosecutor's Office about this disobedience, which could initiate legal proceedings against the responsible authorities or even against the President of Mexico herself. According to the judge, this would constitute a crime of disobeying a judicial resolution, which would lead to legal actions by the Public Prosecutor's Office.

Judge Juárez mentioned that she still does not have confirmation if the competent authorities have been notified about the resolution demanding the elimination of the reform from the Official Gazette, but once this is verified, they will have 24 hours to comply with the suspension. She emphasized that she has no authority over the decisions made by the Public Prosecutor's Office regarding possible legal actions, such as requesting arrest warrants against the president or the non-compliant authorities.

In the event of legal action against Claudia Sheinbaum, the judge clarified that since she has immunity, a trial of origin would be required to remove it, a process that would need to go through Congress. In this regard, she pointed out that before initiating legal proceedings against the president, the federal Public Prosecutor's Office would need to achieve this impeachment through the legislative chambers, which could be a complicated process given the current political composition of Congress.
