Political Battle for Presidency of Nuevo León's Administrative Justice Court

A political battle is unfolding in Nuevo León over the presidency of the Administrative Justice Court. The ruling party, MC, seeks to maintain control by appointing its candidate, while the opposition, primarily from PRI and PAN, attempts to block this move through legal mechanisms. The future of the state's judiciary hinges on the outcome of this struggle, which will be crucial for the next electoral cycle.

Currently, it is estimated that an ally of MC (Citizen's Movement) will achieve the presidency. However, the opposition will seek to complicate their arrival, as in the case of the Treasury or previously the Counselor of the Judiciary. In the event of a legal impediment, the current president-magistrate, an ally of MC, could impose her ally Laura Montelongo Martínez; the latter secures the majority in the tribunal so that the state ruling party can impose a president on the TJA (Administrative Justice Court). In the opposition, mainly from PAN (National Action Party), they analyze this situation with a certain discouragement: 'The truth is, MC has two of the three positions in the chamber... but there must be room for judicialization,' a leader from the Front slips. In the PRI (Institutional Revolutionary Party) camp, they are trying to reactivate, once again, a definitive suspension of a Collegiate Court that ruled that Laura Montelongo should not serve in said court and that Jorge Maldonado Corpus should be reinstated. With the upcoming renewal of the presidency of the Administrative Justice Court of Nuevo León next week, the Palace of Cantera points to retaining this judicial instance due to the majority of magistrates in the Higher Chamber and Ethel Maldonado's intention to retain the top position. According to what LPO could learn, Maldonado seeks to repeat in the position arguing that her current presidency precedes from an interim period. It should be noted that the magistrate linked to the PRI still receives a salary without being in functions in the Court due to said suspension. Previously, the Congress approved the return of the magistrate linked to the PRI, however, Ethel Maldonado, as substitute president, prevented said arrival from being completed and promoted Montelongo Martínez from Secretary of Study and Account to magistrate to achieve a 2-1 vote in the Higher Chamber. Next week, a renewal in the tribunal for the 2026-2028 period must take place, which will be key for the next electoral process. The Law does not allow for re-election.
