The National Human Rights Commission (CNDH) issued Recommendation 194VG/2025 for serious violations directed at the Secretariat of the Navy (Semar), the Attorney General's Office of the State of Guanajuato (FGE), and the Secretariat of Security and Peace (SSP) of that entity, after confirming that a detainee was a victim of torture in 2019 during an operation in the municipality of Villagrán. According to the body, personnel from the three institutions participated in or witnessed the aggressions without reporting them. According to the investigation, the victim was detained in March 2019 inside their home, where they were with their daughter. The CNDH pointed out that Navy elements carried out acts of torture to demand information about people they did not know, while state police and agents from the Criminal Investigation Agency remained at the scene without intervening. 'Responsibility of the three institutions was accredited due to the violation of the human right to integrity and personal security of the victim,' the body reported. The Commission added that state police and Public Ministry agents 'witnessed the aggressions […] and omitted to report it,' in addition to justifying the injuries with false versions about the origin of the damage. The CNDH stated that the marines directly participated in the aggressions, while the police and ministerial agents covered up the facts, even altering the official version of the place and circumstances of the detention. The Commission determined that three public servants who carried out the presentation have direct responsibility, but also requested that all members of the operation whose identity has yet to be established be investigated. The recommendation requires Semar, FGE, and SSP to comprehensively repair the damage, including economic compensation and psychological attention for the victim. The institutions must collaborate with criminal and administrative investigations before the FGR and the FGE, as well as give courses to prevent torture and issue a circular to guarantee that all detentions are carried out under constitutional and human rights standards.
