
The Electoral Tribunal of the Judiciary of the Federation (TEPJF) has overlooked a series of errors in the purification of the list of candidates for the judicial election next June. The Superior Chamber of the TEPJF met to resolve 158 appeals against decisions from the three Evaluation Committees and the Senate, most of which were dismissed.
"The responsible committees no longer exist, as the drawing process has already passed. This is evidently irreparable," stated Judge Felipe de la Mata, who is part of the majority bloc along with judges Felipe Fuentes and Mónica Soto. De la Mata and Fuentes emphasized that once one stage is exhausted, the actions become irreversible and cannot revert to a previous stage, underscoring the importance of prioritizing the principles of certainty and legal security at this stage.
However, against this decision voted Judge Janine Otálora Malassi and Judge Reyes Rodríguez Mondragón, arguing that the lack of certainty in the process means overlooking significant errors. Otálora highlighted at least two cases where she proposed correcting the harm, based on compelling evidence presented by the complainants, which was dismissed by the majority bloc.
The stance of Otálora and Rodríguez Mondragón generated the annoyance of the presiding judge, Mónica Soto, who questioned Rodríguez Mondragón about the legitimacy of dismissing certain evidence. The latter asserted that as long as the INE does not have the definitive lists, they remain at the same stage, and that there are evident errors that cannot be ignored.
Finally, the TEPJF decided by a majority of three votes to two, to approve the errors detected in the electoral process, arguing that there is neither time nor Evaluation Committees that can rectify the harm to the affected individuals.
