
The National Electoral Institute (INE) has established the possibility of annulment of the candidacies of judges, magistrates, and ministers to the Federal Judiciary if any of them do not meet the necessary eligibility requirements. The General Council of the INE approved a mechanism aimed at reviewing the candidacies for the Judiciary to detect any non-compliance with legal requirements, such as having any history of violence against women, being food debtors, or being fugitives from justice.
In this regard, it was agreed that the procedure will review whether the candidates for positions in the Judiciary have incurred in family violence, domestic violence, violation of sexual privacy, gender political violence, being fugitives from justice since an arrest warrant is issued until the criminal action prescribes, or having a final sentence that imposes suspension as a penalty.
One of the important aspects of this procedure is the possibility for citizens to present evidence that confirms the allegations against the candidates. A platform has been enabled for these evidences to be submitted, with the expectation that it will be ready starting April 25.
It was agreed that a preliminary report will be presented on June 2 with the information provided, one day after the judicial election. Subsequently, on June 15, when the INE begins the sessions to validate the election results, a decision will be made on whether any of the winning candidates meet the requirements established by law.
Advisor Claudia Zavala argued that there are two moments to analyze whether a person possesses the qualities to hold a public office: during the selection process of the Evaluation Committees and when the INE declares the validity of the election. She stated that if it is confirmed that a candidate does not meet the established requirements, they must be declared ineligible and the corresponding certificate cannot be issued.
In summary, the INE is preparing to carry out a rigorous review process of the candidacies for the Judiciary in order to ensure that the selected candidates meet the legal and ethical requirements to hold such positions.
