Family Lawyers Accuse Mexico City Prosecutor's Office of Cover-Up in Festival Death Case

The legal team of the slain photojournalist Berenice Giles accuses the Mexico City Prosecutor's Office of helping companies Ocesa and Lobo avoid liability for the tragedy at the 2025 Axe Ceremonia festival. Lawyers claim the agency spread disinformation and may have warned the companies in advance of the charges.

The Giles Rivera family and their legal team have gone through an institutional hell to get Ocesa and Seguridad Privada Lobo to be formally charged in the investigation file for the 'AXE CEREMONIA 2025' case,' says a statement sent by Berenice Giles's family's legal team to Aristegui Noticias. 'I must not fail to mention that throughout this matter, the FGJCDMX has been covering up and protecting OCESA and LOBO, and the legal counsel for the Rojas Hernández family did everything possible to prevent OCESA and LOBO from being charged, and even today, they continue to do everything possible so that OCESA and LOBO are not charged in the initial hearing of this process,' the statement concludes. Last week, during a protest, the lawyers of Berenice's family stated that Ocesa and Seguridad Lobo filed for an injunction (amparo) to avoid formal charges in the Prosecutor's Office investigations into the deaths of photojournalists Celaya Torres and Miguel Ángel Rojas. After the official position of the Mexico City Prosecutor's Office became known last September, which exonerated Ocesa and Seguridad Privada Lobo from the deaths of photojournalists Berenice Giles and Miguel Ángel Rojas at the Axe Ceremonia 2025, Berenice's legal team filed a transparency request demanding to know the officials responsible for issuing the response sent to Aristegui Noticias, as well as the legal grounds for exonerating the companies from liability. In response to the request, the Prosecutor's Office replied on January 21, 2026, with an official letter: 'In this regard, I inform you that the document subject of the information request, attached to the same and found on the portal referred to as 'Aristegui Redes Sociales' under the title 'Fiscalía CDMX deslinda a Ocesa de muertes en Axe Ceremonia', was not issued by this Prosecutor's Office of Justice of Mexico City, therefore there is no statement on the request, since it is not an official document.' Because the capital Prosecutor's Office denied having issued an official statement on the matter, Berenice's legal team suspects that the text 'could have been fabricated by Ocesa and Lobo to launch a paid disinformation campaign that would allow them to deceive public opinion and make everyone believe that the capital prosecutor's office had already resolved to exonerate them of liability in the AXE CEREMONIA 2025 case.' Aristegui Noticias contacted the communication team of the CDMX Prosecutor's Office, which reiterated that the response sent to this medium was indeed prepared by the institution, however, it stated that it is not an official press release since it was a written response sent specifically to this medium. As the agency clarified, a response made specifically for the media has a different scope than an official bulletin. Based on this distinction, the institution denied the information requested by Berenice's family and their legal representation. Initially, this reporter asked the Prosecutor's Office's communication area for a statement for the article 'Documents show that OCESA did organize Axe Ceremonia; Lawyers accuse of cover-up,' published on September 26, 2025, at 11:54 PM. The request was made that same day at 11:36 a.m., receiving a response three days later through a PDF document. On September 29, the communication team sent a document with the watermark and logos of the CDMX Prosecutor's Office that reads: 'The Prosecutor's Office of Justice of Mexico City (FGJCDMX) has as its priority to seek justice for the victims and their families. Based on the evidence gathered, it was determined that OCESA was not the organizer of the event nor did it have the status of a guarantor. Its participation was limited to access control services and the commercialization of sponsorships, without relation to the collapsed structure or the Civil Protection Program. The company Agencia de los Socios S.A.P.I. de C.V. was the organizer of the festival, and Operadora Eclectic S.A. de C.V. filed the program with the competent authority. The CDMX Prosecutor's Office reaffirms its commitment to act with objectivity, transparency, and strict adherence to the law, ensuring justice for the victims and their families.' This response was published on September 30 of last year in the article cited by Berenice's legal team in their transparency request, as well as on October 2 in a video published on the Aristegui Noticias YouTube channel. Although the Prosecutor's Office's communication team stated that the September 29 response was written by the institution to directly respond to this medium, Berenice's legal team detected that the same message was also massively disseminated by a public relations agency called Zimat Consultores, which has operated in favor of Ocesa and Ticketmaster on other occasions, for example, in the midst of the scandal unleashed by the chaotic ticket sales for BTS in Mexico. 'Unfortunately for us, that press release was disseminated and replicated—with all the implications that entails—by hundreds of media outlets (national and international).' After a review in the databases of the Federal Judiciary Council, Aristegui Noticias corroborated the existence of these legal remedies. Both indirect amparo appeals were filed on January 12 of this year, before the Fourth District Court in Criminal Matters in Mexico City. According to the Giles family's lawyer, the date of filing both appeals raises suspicions, as they were filed two days before the judge made the formal charge effective. 'This makes us think (that) it was the prosecutor's office that gave this information to Ocesa and Lobo so that they would go ahead and process their amparos,' he accused. The amparo filed by Ocesa is identified with file number 68/2026, while that of Seguridad Privada Lobo is shown with the number 67/2026. Likewise, it was accredited that Servicios de Protección Privada Lobo, S.A. de C.V. had no responsibility for the assembly of the structures or for the supervision of the civil protection program. In both cases, the judicial authority denied the companies both the provisional and definitive suspension they had requested. As a result of the events that occurred on April 5, 2025, at the Axe Ceremonia Festival, a broad and exhaustive investigation was carried out that included more than 120 interviews, multiple specialized expert reports, inspections, and video analysis, as well as proceedings with public servants, emergency personnel, and people linked to the event's organization; from these inquiries, criminal actions were taken against eight individuals and three corporations, and reparation of the damage mechanisms were promoted for the victims' families. Their labor was limited to private security tasks, such as access control, verification of credentials and tickets, organization of lines, and maintenance of order during the event.
