The president of the Justice Tribunal of Querétaro, Braulio Guerra Urbiola, stated that in many aspects, the Querétaro reform is aligned with the federal reform. He highlighted that this document adds mediation and alternative conflict resolution mechanisms to the Constitution, making conciliation a key factor to prevent all cases from going to trial. He celebrated that agreements have been reached to advance on this issue; however, he pointed out that the major challenge will come in the secondary laws, where it will be necessary to act with technical care and precision. “In regulatory reforms, that's where the devil is, that is, where the details and minutiae are, one must be very technical for the Judicial Power to function starting in 2027”. He emphasized that this is an unprecedented scenario, as for the first time, the voting for judges and magistrates, as well as the creation of a disciplinary court and an administrative body, are contemplated, so it will be a model to be tested with areas for opportunity. In this sense, ahead of the vote scheduled for this Friday, he said he respects the legislative work but insisted that the reform must focus on the citizenship. “Of course, we want the legislators to think about the administration of justice for the people who claim a right in Querétaro… this has nothing to do with the judicial officials, who are just passing through”. He added that, as the Judicial Power, they have defended the acquired rights of the personnel, and recognized that the Congress has been respectful of the 1,600 people who work in the administration of justice. The judicial constitutional reform, approved in commissions in the local Congress, fully complies with the bases and principles of the federal reform, highlighted Braulio Guerra Urbiola, president of the High Court of Justice in the state. However, in the face of rulings by the Supreme Court of Justice of the Nation (SCJN) that invalidated judicial laws in Durango, Nayarit, and Guerrero, he warned that everything is subject to review. “And the Court can always qualify if there is something that deviates from the bases of the Federal Constitution, it will always carry that risk”.
