The head of the Women's Secretariat, Citlalli Hernández, announced that the Querétaro Prosecutor's Office has withdrawn all criminal actions against Esmeralda, a 14-year-old girl who was accused of intentional homicide. After working sessions with the prosecutor of Querétaro, Víctor Antonio Jesús Hernández, the state prosecutor's office presented the withdrawal of the charges. Both the federal and state governments will offer support to the girl to ensure her reparation and prevent the case from recurring, ensuring that she will be accompanied for her development in peace and well-being.
In Esmeralda's case, the collective Adax Digitales reported that the Querétaro Prosecutor's Office accused the girl of qualified homicide after she suffered a miscarriage following a presumed rape by one of her relatives. During the intermediate hearing, a three-year prison sentence was requested for the girl in a social reintegration center. A high sum was requested for damage repair for the alleged aggressor, despite him denying the events in his statement.
The prosecutor of Querétaro mentioned that the process was based on homicide since an expert report indicated that the baby had been born, breathed, and then was asphyxiated. In a subsequent video message, no further details about the case were provided, but it was assured that the well-being of the minor would be a priority. Citlalli Hernández also announced that the staff of the Querétaro Prosecutor's Office would be trained in gender perspective, signing a collaboration agreement for that purpose, and public servants involved in this case of the 14-year-old girl would be investigated to identify possible failures or omissions.
A call was made to the local Congress of Querétaro to legislate and decriminalize abortion in the state. Hernández reiterated that women in Mexico have support and are not alone.
