The content creator known as 'Fofo' Márquez has denied his guilt and the charges against him, thus complicating his legal situation. The victim seeks the maximum penalty for attempted femicide, the crime for which he is being tried.
So far, the reasons why 'Fofo' decided not to accept his guilt in the case of the viral videos in which he appears assaulting Edith are unknown. If he had accepted a plea bargain, he would have received the minimum penalty, which in this case was 11 years and eight months in prison, a fine, and reparations for the damage to the victim.
By rejecting this option, the Public Prosecutor's Office will seek the maximum penalty. If found guilty, 'Fofo' Márquez could face up to 48 years in prison, the maximum for the crime of attempted femicide. The penalty being sought is fixed and non-negotiable, which will initiate a new phase of the process in which evidence will be presented to determine his guilt or innocence.
After the hearing on November 21, a decision to open the trial is expected in the coming weeks for 'Fofo' Márquez. During this stage, a Trial Judge will be responsible for determining whether the evidence collected is sufficient to reach a verdict. After a process of about 7 months, a hearing will be held to assess his situation in the case of attempted femicide against Edith Márquez.
In the Oral Trials Room 10 of the Barrientos Penitentiary in Tlalnepantla, State of Mexico, the Control Judge offered 'Fofo' Márquez a plea bargain that he rejected, indicating a more complex stage in the influencer's legal process.
